1. Acceptance of Terms

Welcome to Travel SMPL (“Travel SMPL,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of travelsmpl.com (the “Site”) and any experiences, services, or bookings made through it (collectively, the “Service”).

By accessing the Site or booking an experience through Travel SMPL, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Our Role as an Intermediary

Travel SMPL curates and facilitates bookings for independent, local experience providers (“Hosts”) across Spain, including but not limited to wineries, restaurants, guides, and other local businesses or individuals.

Travel SMPL is a booking intermediary, not the operator of the experiences listed on the Site. Each experience is independently owned, operated, and delivered by its respective Host. Travel SMPL does not employ Hosts, does not control the day-to-day conduct of any experience, and is not present during the delivery of the experience unless explicitly stated.

While we take care to select Hosts we know and trust, Travel SMPL is not responsible for the acts, omissions, quality, safety, or conduct of any Host or third party during an experience. Any disputes regarding the conduct or quality of an experience should first be raised with Travel SMPL, and we will do our best to mediate in good faith with the Host but final responsibility for the experience delivered rests with the Host.

3. Bookings & Payment

All experiences listed on the Site are subject to availability and confirmation by the Host.
Prices listed are per person (or as otherwise noted) and are inclusive/exclusive of taxes – gratuity is not included
Payment is due in full at the time of booking unless otherwise stated on the experience listing.
Travel SMPL processes payment on behalf of Hosts and retains a commission on each booking; Hosts receive the remaining balance according to the terms of our separate Host agreement.

4. Cancellations & Refunds

Traveler-initiated cancellations:

Cancellations made 30 days before the scheduled experience date will receive a full refund.
Cancellations made within 29 days of the experience date are non-refundable, except at Travel SMPL’s discretion.
No-shows are non-refundable.

Host-initiated cancellations:

If a Host cancels a confirmed booking, Travel SMPL will notify you as soon as possible and offer either a full refund or the option to rebook another available experience or date.
Travel SMPL is not responsible for any additional costs incurred by the traveler as a result of a Host cancellation (e.g., transportation, accommodation), except where required by law.

Weather, illness, or force majeure:

In the event an experience cannot proceed due to circumstances outside either party’s control, Travel SMPL will work with the Host to offer a rebooking or refund where possible.

5. Traveler Responsibilities & Assumption of Risk

By booking an experience through Travel SMPL, you acknowledge that:

Experiences may involve travel, food and beverage consumption (including alcohol), physical activity, and time spent in unfamiliar environments, and inherently carry some degree of risk.
You are responsible for assessing whether an experience is appropriate for your health, physical condition, dietary restrictions, or other personal circumstances, and for communicating any relevant needs to Travel SMPL or the Host in advance.
You agree to behave respectfully and lawfully during any experience and to follow the reasonable instructions of the Host.
You participate in any experience booked through Travel SMPL at your own risk, to the fullest extent permitted by law.
You are responsible for obtaining any travel insurance, visas, or documentation required for your trip to Spain.

6. Host Relationships

Hosts featured on Travel SMPL are independent providers, not employees, agents, or partners of Travel SMPL. Hosts are responsible for maintaining any licenses, permits, insurance, or certifications required to legally operate their experience in Spain.

Travel SMPL reserves the right to remove any Host or experience from the Site at its discretion.

7. Intellectual Property

The Site and its original content, branding, photography, and design are the property of Travel SMPL and may not be copied, reproduced, or used without prior written permission.

8. Limitation of Liability

To the fullest extent permitted by law, Travel SMPL shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service or participation in any experience booked through the Site, including but not limited to personal injury, property loss, or trip cancellation costs.

Travel SMPL’s total liability for any claim arising from your use of the Service shall not exceed the amount you paid for the applicable booking.

9. Links to Other Websites

The Site may contain links to third-party websites not owned or controlled by Travel SMPL. We are not responsible for the content, policies, or practices of any third-party sites.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, United States, without regard to its conflict of law provisions.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated with reasonable notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
